lit bit long but worth it for someone moving to new room. My frens ( a couple who came from Nepal few weeks ago) were looking for a room in new york. We found someone (Nepali) posted on sajha about looking for a roomate. we went there on last friday April 30, finalized to stay and moved on saturday. After putting all belongings in the room, we roamed around the city and they returned back to their room. On Sunday morning, they found that their traveller cheques were missing from the bag. They searched all bags n everywhere and did not find. I went there, reported the stolen cheques to the issuing bank and made them void. There after I set up a camera in video mode on the room and we went outside. After one and half hours we returned back and played the recorded video just to find out that the tenant who posted the room ad came inside the room in couple of times interval, opened all the bags and baggages, searched inside the bags and took couple of stuffs, including nepalese currency and one ladies pad. My frens didn't want to live there anymore after watching the video and so we looked for another apartment, found the one and moved on Monday evening. I talked to the tenant about everything and told to return the 600 dollars my fren gave on cash on Saturday as one month rent. She rejected giving it back. I am in the process of suing the tenant on small claim court however some suggestion needed on it. How do we get back the 600 dollars? Can we press charge the tenant based on video?? Do we have the full authority on the video to post it online like sajha or youtube since we were not spying on anyone, were trying to find out who entered into the room when my frens were not there??

Didnt you tell her that you have the video of her opening the baggage and stealing the stuffs and that you will take that video to cops and that she will be charged of theft? I think she will then easily return the money.

I did tell her about the video, and again she rejected to return the rent. regarding cops case, i am going thru that before going to court, just wanna have some info on if it is legal to post her name, address, n video over here or somewhere before somebody falls into her entrapment again as she will be looking for roommate again.

Do not post anything publicly. That's the next step. Get cops involved for the theft case but you have to act quickly. You cannot press charges 5 years after the fact. Just do it.

Call a police precinct and ask if they can help. Sometimes when a cop shows up at the door they give in. If this doesn't work then file in a small claims court. A video proof might not stand in a criminal court etc, but it should hold your case in the small claims court; take the cancelled traveller's checks etc.

Don't under any circumstances threaten the thief saying you will post the video on a publicly hosted website because they in turn might sue you for blackmailing, go to the cops file a charge against the person and if it does not work out wait it out at the small claims court. goodluck

Why not just go to the cops and file charges like any law abiding citizen? You caught the thief red-handed and have evidence to back up your claim, I see no reason on not following the legal recourse.

Do not kill your case by posting the video of theft. Just keep it in the secure location as a proof to the case. Go to cops and explain it all. The cops will make a theft report that will help you to the next. Good luck! Shame on her who likes to call a Nepali and posts a "roommate wanted!" on sajha. Can't believe, how people are greedy and committs crime in that way.

Well i cant believe all this shit is happening...while i was in big city may be i was lucky that i came in contact with the most helpful persons i have ever met...but i have heard of these kind of stuffs everywhere...i dont know if its better to post her name and address over here to alert other ppl from falling in to the trap...but i would certainly do that cos u get what u deserve

thanks guys for ur suggestions, well i am in the process of filing case against her. just wanted to share this n have suggestions. Of course that girl shud also be looking these posts. Just did not want to post the address n name details before processing. Any post i see in sajha from that girl, i will be alerting to people so that no one will go thru the difficulties my frens went into.

Live after more than a year!!!
At the first i thought someone again got into the similar problem,
anyway, my friends got the TC's money from bank with lil bit of hassle and yes we did take her to court and even without looking into photos and video, the judge ruled in our favor compelling her to pay us not only the month rent but also the court fee and the interest at 5%. So the outcome was pretty good.
