Hi Guys, My petition was filed at vermont on the 24th of may, 06. It got approved today (5th sept.), i rec'd an email few hours back. I live in Nepal and was interviewed by the company over the phone (4 rounds). I did my 3 year bachelor in IT from India and have more than 2 years of full time working experience. What would be my next process now? Could you guys throw some light on this? futball

I got in a NJ based IT Company. I guess the petition approval certificates will be sent to my employer first, who, in turn will send those documents along with the company details, profiles to me later for application. Is it true that USCIS sends some documents to the US embassy? What are the chances for me?

u should contact ur employer for that. They would know more on how u can go about applying for ur visa. Seems like u got a job with indian consulting company if im not mistaken. U need to have ur H1 approval notice with ur to apply for a visa in ktm, this i know for sure. Just call or email ur employer. He should guide u from here on.

I donot know what exactly USCIS sends it to US Embassy, but they may have a system to check your h1b approval and all that. Follow the guidelines for visa and get all your papers from employer, your degrees, resume and all other supporting docs. It should not be difficult to get h1b visa. Good luck.

Futbal, Can you find out what processing center processed your H1. I know they are all sent to Vermont to start off, but due to overload, they were moved to different states. Do you know whether yours was processed in Vermont or a differet state. It seems like all the other ones are doing a good job except for the Vermont one. I filed mine in April and still haven't received any update. Thanks

contact ur employer, they should send you a packet with all the docs you would need. letter from lawyer stating that u r an employee at their co. H1B Approval doc from USCIS etc.. but I wonder how they would give you evidence of pay stubbs? usally H1B is given to current employees who are on OPT if i am not mistaken. But I am sure.. those dhotti baiyas shall provide u with those... as they have been able to make lots of other type of docs without any problem... Good LUck!

The Vermont processing center sucks! they 'updated' the processing dates yesterday, but for H1B, its still April 30th!! WTF!!! it was April 30th the last time. so are they saying they didnt do sh.it for 15 or so days? unbelievable. My OPT ran out on August 15th, and i guess i still have untill October 15th to get a visa. does anyone know what i need to do if its October 15th and i still dont have my H1B approval?

bluebus, When did u apply your H1B? If it's late May, then probably you would have to go for premium otherwise be patience for 1 or 2 weeks. Mine was applied on May 1st and got approved yesterday.

Yeah. Although, the processing time shows April 30th, but I got approved. I don't know how. I have another friend applied on April 27th and he got approved way back, almost one month back. I don't understand the way they process the application although they have mentioned that they prioritize according to the application dates.

delicate, my application date is May 25th. khai ke garne garne. I asked my Lawyer (lawyer's assistant actually) and he always says 'ai halcha ni bhai, dhanna mannu pardaina....October samma sabai process huncha'. But with all the bad experience i had with this particular Nepali lawyer's firm, i dont believe a word of what they say. i might go for premium if nothing comes up by next week. but just wanted to know what would happen if i overstayed my 'grace' period, i.e. 2 months after my OPT expires. according to my lawyer's assistant, as long as i have my H1B status 'in process', i can overstay as long as i want. tara aba pattyaune napatyaune arkai kura ho.

bluebus, OMG! If its May25th, then in my opinion its hard to get within this month. I ain't sure that whether you can overstay after the grace period or not, but I have heard about this matter that it's possible. But hey, I would wait till next week, and go for premium, instead of taking all these risks. At least you will be mentally worry-free instead of cramming until the last moment. Go for premium if it doesn't come by Sep 29.

Futball, Since your case was filed as "Counselor Processing" the USCIS will send a copy of the approval notice to the consulate in Nepal. In the mean time they will also send the approval notice (I-797 document) to your employer who will then send the following to you so that you can go and apply for your H-1B visa. Invitation Letter I-797 (Approval notice) ETA-9035 (Labor certification) I-129 (Forms) Then you will need to prepare the following for visa interview: •Visa Application Form DS-156 (males complete DS-157) Go To: http://kathmandu.usembassy.gov/ •Passport •A recent photograph, with signature on the back Go To: http://travel.state.gov/pdf/Photo%20Guide%2010-01-04.pdf •Original degrees •Original I-797 Approval Notice....you will receive from your company •Copy of the H-1B petition (Form I-129)...you will receive from your company •Copy of the certified Labor Condition Application (LCA)...you will receive from your co. •An original, current letter from your company confirming your offer of employment If you have a spouse/dependent then they can also apply for an H-4 visa.
