Don't sweat dude. If you have her insurance company info, call her insurance and make them pay for it. It's not your fault so don't reveal your insurance info with her company or call your insurance company (to make a claim).

She did not got neither ticket nor warning. I felt his report favors to the lady.

Did you call the tow truck? NO

Did anyone injured at the accident? NO

All tires are OK and you can drive? Yes

Your air-bag is not deployed. Yes

Did anyone violate the traffic rules, like did not stop at stop sign, crossed red light? NO

Both of you have insurance. Yes.

IF all the answers are as it is THEN your police report should be minor accident with minor damages.

just call her insurance, if she changes her story or if the insurance doesn't want to pay. i think you have 2 options, 1 is to take her to a small claim court, 2 , is to file with your own insurance and pay for deductible and get it fixed and later hope that your insurance will surrogate it. but since u did call the cops at the scene , which is the wisest decision you made, i think it will be almost impossible for her to change her story. i think her insurance will pay your easily , just call them. btw, did the lady think it was her mistake and gave her insurance info to you?

Just call your insurance and tell ur side of the story and tell police report is wrong since the police was not there at the time of incidents. Did u take all the picture of both the cars? Parking lot? The spot? Etc..

In my state if something like this happens in a private lot (shopping complex parking lot) and if both the vehicles are in motion than it is not anyone's fault. If you were stopped and she was in motion it is her fault. Either case a ticket may not be warranted. I would recommend to follow what sidaNepali suggested. I would suggest to file a claim online rather than calling. It is easier plus you type your own report. Also attach all the pictures of the damage and if the lady had accepted fault make sure you put that in the claim.

Same thing happened to me a while back but we did not get the police involved. The guy agreed it was his fault, I took pictures of everything, we exchanged insurance information. I filed claim with his insurance company online. I also called my insurance and let them know what had happened (only informed but denied to file a claim) so that they would know if the other guy tried to file claim they will already have my side of the story.

Oh and forgot to mention that his insurance paid for the damage. My damage was very minor compared to yours, I went to their recommended body shop, got a quote for $1500, sent the quote to them and ask they send me a check so I can get it repaired at the shop of my choice. They sent me the check. I bought a scratch repair kit from a auto shop for less than $10 spent less than an hour and the damage is almost invisible unless you take a close up look.
My car is already more than 10 years so did not want to spend that much money to repair. Tyo paiso le masta moj gariyo.

It's a minor cosmetic damage . Nothing mechanical .

My concern was and is , when I was cited or involved in accident it was always mentioned who is in fault . If that was mentioned it would have make me easier to handle the case.
Right now door does not open from outside and not able to get rental car.
I started to looking for a door with exact color , found one for 150 and 50 to put it on. I would not worry about scratches.

well gorkhe bhai like I said since it was on a private lot may be same law applies, no one is at fault. just claim it to her insurance if you have the info. If not and you dont want to hassle with it just spend the $200 and move on.
