Hi folks;
I have one question regarding in us universities when one is in h1b status. I heard for h1b it is in-state fee for every uni unlike for f1 it is out of state fee,is it correct? My other question is person is in h1b with company A, and now can he take leave for 2-3 yrs from the company and do the study with still h1b status fulltime in university..this way he have the privelage of in-state fee,isn't it? I am just asking if it is possible or company normally allow this to happen or once the guy is in uni registred as full-time his H1b will change to F1. Also other quick question is what happen if company A is desi(dhoti) consultancy? Will they allow or does this situation occur to somebody here in forum. Will appreciate if somone can shed a light onto it.Thanks..

Legally you have to be working full time to maintain your H1 status but u can be full time student at the same time and pay the in state tuition. Be careful coz Desi companies do all kinds of illegal stuff which may jeopardize ur GC application in the future.

it is not just h1b that guarantees your in state tuition at the universiyt.after having h1 status or permanent resident card one should have dweling in the desired state for at least 1 year which can confirm that the person chooses to make the state his permanent stay ..
and it is strickly no for a 2-3 yrs leave from a company and b studying ... coz h1b status in itself not a looooooong term visa status in USA ,while F1 has status till duration.

In theory, the maximum duration of the H-1B visa is six years (ten years for exceptional Defense Department project-related work). H-1B holders who want to continue to work in the U.S. after six years, but who have not obtained permanent residency status, must remain outside of the U.S. for one year before reapplying for another H-1B visa.

There are generally two exceptions to the 6 year duration of the H-1B visa:

If a visa holder has submitted an I-140 immigrant petition or a labor certification prior to his 5th year anniversary of having the H-1B visa, he is entitled to renew his H-1B visa in 1 year increments until a decision has been rendered on his application for permanent residence.
If the visa holder has an approved I-140 immigrant petition, but is unable to initiate the final step of the green card process due to his priority date not being current, he may be entitled to a 3 year extension of his H-1B visa. This exception originated with the American Competitiveness in the Twenty-First Century Act of 2000.[11]

Hi,

After reading this thred i too wanted to know about my confusion redarding visa status. If i am H1B Dependent..

what is the logical reason for not letting me to work legally ??

And secondly, does this restriction apply to college too.. in which i am studying or college jobs not under restriction ??

Is there anyways i can work legally unless my husband gets green card ??

Hope to get the answer

visa holders are allowed to full time or part time study during their stay in the United States.
Under any circumstance, H4 visa holders are not authorized to earn income in the U.S. To be precise, an H4 holder can not be employed while in the U.S. If the visa holder desires to work in the country, he/she must obtain a work visa, which is a non-immigrant visa that allows the person to temporarily live and work in the U.S. Foreign nationals who start employment without the proper visa are breaking the law and may be expelled.

depport deport deport deport.. if you breath - you get deport, if you have intensions to stay here you can get deport.. if you don't go to school, deport.. go to school, can't pay, deport.. work - deport.. don't work, no money no fees no school, no status, deport.. hahaha fking deport is the most heard word for any f1s.. in the usa....

I wonder how all the foreigners who are naturalized and or now have green cards got their legal status... i wonder if everyone came in family visa and dv .... hmmmm.. i wonder how many true asylum receivers from Nepal....... one day we all have to be deported; from this world.. just cuz you have american citizenship does not give you permanent residency in this world.. so lu ja.. one day everyone has to get deported from this world.. so deport.. deport...
