Hello, I graduated last august and got my OPT from october. I used the 60 days delay on OPT start date allowed by USCIS. However, since now my OPT expires this october and I have not applied for another university for this fall, nor am I sure about my H1B approval. How long can I remain in the US legally after my OPT expires? Is the 60 days delay i took after graduation same as the 60 day grace period allowed after the expiry of the OPT? In other words, am I still eligible for the 60 days grace period after the expirty of OPT? How can I reinstate my status any time soon after the expiry of my OPT? Any information would be helpful for me. Thanks

I beleive you can. During 60 days gap between your graduation and OPTstart date, you were in F1 status. But now, the other 60days after your OPT expires, you will be out of status. I think the later one is called the grace period, where you can stay in the US being out of status for 60 days.

yes, you can stay for 60 days grace period after your OPT expires. As in my case, my OPT started a month later and i was given 60 days grace period. During this grace period, i applied for Masters, and i received a new I-20 within this grace period. You need to apply for college asap, and get an I-20 before the 60 days grace period is over. You can apply for Kaplan for the time being. They issue I=20 for few programs like iGRE, iGMAT, TOEFL or USMLE programs. I did iGRE with them for 3 months to maintain F1 status. Since your OPT expires in october, your grace period is until december. So you need to apply for a college and get an I-20 before december.

No matter what (you have already taken 15/30/60 days after your graduation), you have " " 60 DAYS GRACE PERIOD AFTER YOUR OPT EXPIRES: THIS IS LAW" ". You are in full F1 status (get new I-20 or change status within grace period), No OUT OF STATUS, NO REINSTATE NEEDED AT THIS TIME. thanks.

Thanks a lot everyone. That info was helpful to make me content for a while. I researched and found out that 60 days grace period is after the OPT expiry. nowhere it says if you use before, you cannot use after expriry but some people confused me. Thanks

Hello Never Quite, Kaplan issues I-20 for international students for limited courses. You need to maintain at least 22 hrs/wk at their lab when you stay on their I-20. Remember that these courses are very limited. Depending on your location, you need to call them and get more info: http://www.kaptest.com/Kaplan/Article/Customer_Service/Customer-Service/Contact-Information/Visit_Us/CS_help_usalocations.html?ProductId=
