If its more than five years, you are not otherwise you are exempt from SS and Medicare taxes, but if you take exemption you wont be filing regular 1040 and you can't take standard deduction.

You are exempt from Social security and medicare but you still have to pay Federal income taxes. You will get refund if enough federal taxes were withheld from your paycheck. You will have to file a 1040-NR or regular 1040 depending on how long you have been in this country.
