Alright guys, I am sure I am getting repetitive as hell right now, but when the problem comes then only do you pay attention to things. My dad lost his job and he was under a HB1 visa so, my question is how long does he have to stay here? Of course, I mean legally. So, if anyone has been through the same thing and is being tortured by the god damn U.S. government, help would be much appreciated.

if I am not wrong, your dad has to either a) find a job or b) leave the country, within 60 days of being laid off.

Talk to an indian consultancy. They will solve your problem for you.

MN_Nepali: what do you mean by filed?...I am really new to the immigration stuff so, I have no idea what the terms mean. The funny thing is I am under his visa so obvioulsy what ever happens to him will affect me as well, talk about luck...

Hello Friends,

It is true that a person who has H1B can change to B1 tourist visa? And if he get a job with in B1 status, can he reinstate his h1B visa?

Please help immigration expert.

lyrices: I read that somewhere as well, I guess it is true the site looked pretty solid so, thats what I told my dad but that is going to screw with my schooling...its kinda gay lol.

Have you/ur dad consult with any attoney about this? What are the options after losing h1B? Let me know if you have any contact information of good Nepali Attroney too.

If your dad is in IT field, he can consult and join any indian run IT consultancy. They will happily accept your dad and file H1 for him. But if he is not in IT field and not willing to learn any IT skill then it might be a problem. And don't forget to consult to a lawyer.
