We do not pay Medicare and Social while working on OPT (Just Fed and State). Can anyone please tell how we need to fill our W-4 for them not to deduct money for Medicare and SS? Any implications on another w-4 after the H1b or past filings?

Just explain your situation to Payroll. Tell them you are on non-immigrant status and are not entitled to pay Medicare and Social Secutiry Tax (these two total around 7.5%) They'll understand. Some of them may ask for copy of your visa/OPT ... (though you might have submitted it to HR). Not a big deal, but act on time. Otherwise you will lose it from your first pay check.

Prakash ji, thanks for the info. But what if pahila cheque ma kaam gare ko and paid all taxes. Now suddenly with the non-immigrant status, no SS and Medicare tax wouldn't give a red alert? Again, visa/OPT might have to be sent to the appropriate authority. Then? Just a lil concerned on the W-4 filling and tax filing issues come next year. What say you?

Procupine, it doesn't matter at all. If you paid the taxes on your first pay, you didn't commit any crime. No body minds if you pay them, right? There ain't any consequences for that. Tax filing doesn't have anything to do it. You always file for Fed and State. Social Security and Medicare wages are to figure out how much credits you earn. YOU EARN CREDIT FOR PAYING THOSE TAXES (MAX 4 PER CALANDER YEAR. $1000 Taxable income for SS and Med give you 1 credit). These credits are useful for retirement, disability benefits, survivors benefits and more. Don't worry about them. Just ask your pay roll not to deduct them from your pay from next time. F1 not entitled to pay those taxes becauseyou are not entitled for those benefits. Hope this helped.

Prakash ji, I think I was not concise earlier. What I was referring to was, hamle pahile student hunda worked in check and paid all four taxes. Even in my UG OPT I paid all taxes. School time ma summer and all was also in check with all the taxes (gair kanuni). Now, suddenly if I move to non-immigrant status with my EAD card or visa sent to IRS to save tax on SS and Medicare, would it not trigger red alert? I can ask the HR hola, but if they send the doc to irs, would it not be rather risky come next tax season? Hope I put it concisely this time around.

Procupine, I think I shall stop here. First thing, I have no idea what papers employers send to IRS. My only guess is they dont send anything, they just report Tax Withholdings. Since I don't have much legal expertise, I'd rather say, if you have too much concerns then its better to get some professional consultation OR pay those taxes as you always did in the past. But I still think there shouldn't be any problem, because many students (above 90%) work off campus saying the are US citizens when they are on F1, then later they move to H1. When that haven't matter then .... it should be okay. Otherwise, the obvious question is: How someone became H1 from citizen? Just my thought.

Many thanks Praksh ji. I understand what you are saying. Just wanted to know if there is actually someone who has done it. I guess there must be over thousands here in this website who must have worked in check illegally and later on OPT without paying SS and Med. If anyone else knows anything regarding this, please let me know asap. Else, thanks and stay safe.
