Dear Friends, I have job under my OPT but my opt is expiring on 31 December, 2006. I went to the lawyer and he said that I cannot file for H1b because there is no visa available. Now what should i do. Should i get the new I-20 from college.

Bishal ji,
There are several bridge courses offered. You may want to join one of them. A one year specialization in the same field you want to work would be advisable.
Once ou start the new course, request for CPT until october. From october start your H-1B.

Of course, the quota for H1B for 2007 is already finished if you mean to apply for industry jobs. The earliest you can apply is April 2007 for the work starting October 1, 2007. However, if you find a job in academic and research institute, the quota doesn't apply and you can get an H1B within a month (suppose you get a job as a research assistant at XYZ university).

Generally, you can't apply for a CPT until you complete two semesters of course work in an institution. If you start a new program in January, probably you will not be able to get any CPT and may not be able to work off campus.

My best advice is to get a new I-20 for yourself as soon as possible (program starting in Spring). Apply for H1B in early April through regular processing (no need to do premium processing in your case as the earliest you can work is in October). Once your H1B work permit is effective, drop your college.

Harris Thank you for your concern. I am teaching at an Private Technical Institute. The Lawyer said it cannot be exempted. I am still confused

That's amazing. If your institute is classified as an "Institute of Higher Education" then it should qualify for the exemption.

If you are teachng, you should be able to get H1B. The quota doesnot appy for academic worker. Maybe you should consider hirig a new lawyer.

There are many loopholes in INS rules. I know if US Government and Public University wanted to apply H1B. I think it is exempt from quota. I have know ideas about Private Schools.
U might wanted to get a good lawyer.
