You can give an entire library of books of such examples...but if it doesnt stand in the court...the entire library is worthless.

In contrary,if you can provide a single page of evidence that can stand in court...that might be enough to get a conviction.

Why do you think OJ Simpson (in the murder of his ex-wife and her partner)
got clean chit.....because the evidence provided by the procecution could not stand in court.

Just becoz the court didnot find enough evidence to throw them in Jail does not mean they are innocent.....Anyone can play around with law....be it with power, money or anything else....Its just the age and the society we live in.....More often than not, Culprits are rewarded, and hardworking people are penalized.....Oh well.....

Politics and News ares all centered in Kathmandu and characters like Khume and Govinde do not need Kathmandu and intelligent votes to win the MP. They do good or expend money at their stronghold and win elections.

So....you are basically saying that it is ok to throw ppl into jails without sufficient evidence.

Actually, you may become the next one to be thrown in jail...for a very simple reason .."it is ok to throw ppl into jail without sufficient evidence" ...if it can be applie to them why not to you as well

I said what???? To paraphrase myself, I said " The court didn't find sufficient evidence to throw them in Jail"---meaning, if the court had tried hard enough without any political intervention, not only Govinde and Khume but more than 75% of our politicians would be in Jail......Hell, we all know, they are all corrupts.....Khaobaadi...its almost imperative that you are related to either of these two corrupts......You can't change what people and have seen with your retheoric buddy..... In my eyes, Govinde and Joshi are as corrupt as they can be.....and I can assure you, I am not alone in knowing/saying so....

Call me a radical. But I think as long as we have the current judges in
our judiciary system, our democracy can't be strong. These are the most
corrupt, the most spineless, and the most shameless people in decades.
The parliament should start impeaching all these chief justices, start
a comprehensive review and public hearing of district court judges (the
conventional wisdom has always been that district court judges are
pretty corupt, but supreme court is a lot better.), and pack the
supreme court with the new breed of professors and professionals. This
includes even Anup Raj Sharma who goes out of his way to defend the
current establishment. I don't even want to talk about the current
chief justice.

If I had any respect for our judiciary so far, it is gone. I hailed
Anup and others when they looked strong against the mandale government.
But , at the end of the day, mandale govt was not saved by judicial
manouvring, and so what they did means nothing to us. If anything, we
owe it all to our martyrs who died during jana-andolan 2. They decided
all the cases against autocracy, and it is always going to be the
people who decide the politics. I don't owe anything to any judge or
his occasional ruling in favor of some radio station or some newspaper.
We want these judge to provide a semblance of civilized nation, to make
sure that people have a place to go when they are wronged, and to make
sure that people have faith on government. It is no more.

Apart from these famous cases, I have heard numerous personal anecdotes
where a supreme court judge has been doubtlessly wrong and venal. The
popularity of maoist kangaroo court (at least in terms of plaintiffs
who went there to register their grievances) was a voice for change. It
is loud, and clear. By acquitting people like , well, no need to name
those jerks, and by acting the way they did in relation to some corrupt
banks, our judges have slapped our people in their face. Let's
restructure this system. This system will never provide justice to the
victims of ,say, maoist atrocities or the military excess if we ever
want to take these cases in the court in the future. Our democracy's
future shouldn't be held hostage by a few of these hoary jerks.

I share the same frustration. It is not only that the outcomes of those two decisions are devastating to the cause against corruption, but the judiciary explanation given themselves sound so hollow, particularly in case of Joshi.

The fact about the functioning of the constitutional bodies of Nepal in recent time, specifically since the King took over the state power in 2003, is that they are essentially FROZEN and not functioning normally (that is, following the normal schedule, procedure and even objectives). How can Joshi get a benefit of ABNORMAL functioning of constitutional bodies happening purely due to non-constitutional factors and historical circumstances ? Joshi's case not accepted due to "time frame" of the case at this time of our history ? How blind and stupid can a judge get than this ?

The acquittal of Khadka sounds equally absurd. The burden of proof for proving that Khadka's property came from legal source is on Khadka himself. And that was the whole case. Now, what does "lack of proof" has to do here ?

I don't understand how can Khadka be acquitted based on "lack of proof" if CIAA has shown that Khadka owns property more than what he earned from legal sources. The "burden of proof" can not be on CIAA to prove that the "extra" property owned by Khadka is illegal; it is on Khadka to prove that they are legal. Or am I missing something ? Any legal experts ?

I certainly smell something very wrong here.

I also think that it is high time we ask for the resignation of all SC
judges, and if they refuse, we must impeach all of them. Honesty, I
feel so betrayed by their histrionics.

Aba pani dhilo garnu hudaina.No chief justice ever seems to be bothered
that it takes years to clear a case. Kantipur alone has highlighted
several egregious cases, for example, there was this woman who was
fighting a case since thirty or something year. Then, there was a
family of four in Birgunj who committed mass suicide (may their soul be
in peace) after costly judicial process. I myself have heard a lot of
stories of corruption in court. Such is the credibility of our courts
that no poor man in our village has ever gone to the court. Where is
urgency? Where is outrage?

Judges have all the allowances, they are given more respect than to any
minister, chief justice's salary is higher than that of prime minister,
and even after the retirement, they are given a lot of opportunities.
It is pretty good to be a judge in our country already reputation and
even finance-wise. We can't satisfy greed of any individual, their need
is pretty well satisfied by the financial package offered to them. I
have no sympathy to these corrupt judges anymore. Because of them the
Maoists kangaroo court is gaining more popularity, and we should act
now. Even if Maoists in deed leave the jungle (far from certainty at
this early stage), there will always be possibility of another
rebellion.

Hope our parliamentarians/govt listens to this. At least. They need to
give people some feeling that there is government, and that our country
is not some banana republic, but a civilized country with thousands of
years of history.

Word on streets is that a substantial amount has been doled out to the justices in these cases. Same can be said about the Rayamajhi commission. Thats why even though they have implicated the King and his cabinet, they will never be convicted. It is universal truth that to convict somebody, you do not make new laws, you have to convict based on existing laws at the time of the crime.
P.S.: Also, in the case of Mahalaxmi Sugar Mills, it was around 40 Lacs.

Its a misfortune for Nepal.
There are other Khaka and Joshi's.
There is big crowd of corrupts in royal camp. Similarily, UML is also blamed for corruption while in government.
Now, we are eager to see Maoists. We have to remain always alerted.

Hey guys! Khaobadi is celebrating along with his father/grandfather duo Khadka and Joashi. The entire Nepalese including Khadka, Joshi and Khaobadi himself never expected such decision from the court.

I guess is the 8th wonder.

Now their voices are raised to defend the verdict and elaborate their innocence.( before the decision they were like mareko biralo chapeko jasta).

The society should continue to boycott them as they did before. People are more effective decesion maker than the court itseft on special occasions.

I don't know anything about OJ's case. I know who he is and what he did but Iam not going to talk about him where I don't have any proof. But for GOvinde. Let me give you an example. can you become that rich (billionaire) with in 5 years after getting a Ministerial position if you were not corrupt. This guy Used to be a teacher and he was also practicing law in Damauli. They moved to Kathmandu back in 1990 when he become a MP and lived in Ghatte Kula in 2 bedroom appt. After that he held an education ministrrial position and started to be corrupt but when he was a home minister he was worst, Let me tell you how these son and dad used to work as a team. For example if you are a police and wants to get transferred son will ask for GUSH and dad will sign the the transferred sheet. The gush varies for position and place. If you are coming to Airport will be the most.
Also when his older son came to Omaha back in 2002, He try to show off what he did back home and how he was making police officers to work, One guy got pissed off and try to knock his ass down and he fled Omaha and went to Oklahoma and now residing in seattle owning a gas station, I also can get into his family life in detail but its too personal and I will have to pass on it. I respect their privacy, although I said this much just to have Khaobadi some idea, If you still support them then you are getting paid.

At the end when Joshi was questioning how he made all that money, he said that his older son made all these money working in a gas station in US ( Such an stupid answer).

Its like Chirinjivi wagle said my dad used to sell KHURSANI and made all these money
( What a stupid answer)

There is no point arguing for/against people like Joshi and Wagle...As I said earlier ;they are termites and worst examples of human beings...

So...Please let's not make them a point of discussion...We should not waste our valuable time talking about these crooks...

Time will come when they will be punished for their crimes..

It is NOT the job of any court (in any country with democartic and fair legal system) in any criminal case to find evidence.

it's job is to examine the evidence presented by the procecution and decide if the presented evidence hold any water.

The job of finding evidence lies on the procecution.

The court can decide a case based on credible evidence made available to the court...it cant decide a case based on what in NOT presented to it.


Why the hell people are mad at me..why not be mad at the procecution team instead for presenting a weak case in court.

By the way if courts were to pre-judge the case even before a criminal trials were to start...and hand down the judgement based on popular opinion...well, Michael Jackson and Kobe Bryant would be in jail today.

We have no idea if the case even received a fair trial....In one of the most corrupt country like ours, its not a stretch to imagine/assume that our lawyers fight a case along the partyline rather than by the merits of the case.......How come they received a clean chit in the midst of all the hoopla going on regarding the peace agreement, and the historic signing......Its just a setup, and yet another proof why our country is heading in the wrong direction...we can say all we want, but unless we have a STRONG anti-corruption agency, free from any political intervention, its close to impossible to seek fairness in our system, be it in the government or judicial......

I personally have nothing against you......its just a disgrace that you seem to be the only one defending one of the most corrupt leaders of our times.....Did you read what Mike Bibby had to say, or you think those are all lies.....didn't seem so......Read all the newspapers in the valley, and see if they think it was a fair judgement handed by the Supreme Court.......Other than Kantipur of course.....Kantipur wags its tail by the corrupts....more often than not.....
