Actually he became out of status for not attending the college for 1 months. as he told me so. so i wanted to know how can he be in status again. And can you tell me is it possible that student will be out of status if he doesnt attend the college for 1 months.

His name is anuj and he was stuyding in ALCC. Its a language institute and it is in new york Alcc is a langauage institute which has tha authority from US government to enroll international students and they can transfer from ALCC to any other ciollege.

If he is already out of status, i think he has to request with USCIS for re-instatement. The consequesences may be both positive or negative. He can contact international student advisor for procedure.

Re-instate through USCIS ... re-instament fee an application and a letter explaining hte cause of out of status, and go through the international advisors...... success rate I have known is 100% ..5 ppl i have known ... all got hooked up... is not a good statistical point of view but might as well take the chance

Regarding the success rate, i think they approve in most cases. I know few years back, they rejected the appeal of a guy who had dropped a class at the middle of the semester thus failing to maintain required minimum units. Instead of giving him re-instatement, they issued him a letter urging him either to voluntarily depart from US within 30 days or face the removal by themselves. I guess there may have been some other reasons behind that decision e.g., poor performance in the classes he completed and or not being registered on time for the following semester etc. I think that was the most severe case. Normally, it should not happen. It also depends on how they take your case and how you present the circumstances behind the inability to maintain staus. If you can show some health reason with substantial proof, it will be excellent i think. The above case i mentioned was just for an example (a true story though). You should be okay. Just complete your process cautiously.

At some universities, international student advisors seem to be quite helpful and co-operative. If that applies to your university's advisor and he already knows your situation, you may seek some advice from him. They may give some idea for safe landing. If that doesn't work, you may need to seek for some counselling from immigration lawers (preferably of Asian background who frequently encounter this type of case).

Oshodeep, be careful while posting your friend's real name and every other details in sensitive issue like this in an open forum. I am wondering why watchdog was insisting to get specific details and has not replied after getting those detail from you. Have you notice that? Insisted of helping your friend, you might be inadvertently jeopardizing his already weakened status. Another point, the topic of the thread is so ‘strong’, catches everyone sight and gives kind of wrong/bad impression. Try to make relatively soft headings. These are my personal suggestions, please don’t take it otherwise. I think your friend will be able to get into regular status if you/he carefully talk(s) to you international advisor. It should not be a big hassle for them. I have seen couple of students due to their economic hardships or any other legitimate reasons getting re-installed into the regular status without much problem. But, it is always good to be careful that one does not get into this type of circumstances. Good Luck.

Hey oshodeep, As far as I am concerned, you can reapply for in-state status but it should be done ASAP. You can mention the maoists situation as the best one which affected family income so that he/she could not pay tuition fee and he had to be out of status. One of my colleague did that and finally he got over with it. So you can give a shot.
