It will mainly depend on the mindset of the judge who will be presiding over the case; if the lawsuit that was filed before contained similar materials and were addressed to the same judge and if it prevailed, then there is no reason this should not. As a peace loving people of Nepal, we do not want to put Trump down, we want to forgive Trump and his team even if they unknowingly discriminated against us. However, if the judge feels that the content of the lawsuit is relevant, that's all that matters. Let's hope our legal representatives are aware of this. Good job Adhikaar & concerned team, we appreciate your efforts... If we recall history, it is clear that it was Nepal that helped make UK "Great Britain". If our Gurkhas had not helped UK, it could have lost many battles and hence would not have become Great Britain. The good news is that the Trump administration also seems to have understood this by now, they now see Nepal as "the most strategic partner" in South Asia (like Israel in Middle East !) as Nepal is "the only remaining last resort" for USA, given both Pakistan and Bangladesh are mostly Muslims, Maldives & Sri Lanka are tiny and both India and China are too big and Bhutan is like a puppet of India and Tibet is under full control of China; that was why there was high level talk between Mike Pompeo and Foreign Minister of Nepal ; the reason why Oli was able to outsmart Prachand on Foreign Policy.. If things go well, US is going to be a great friend of Nepal and it will be the people of Nepal who will help "Make America Great Again" ! What do you guys think... Could someone post the link to the content of the lawsuit filed by other TPS countries that prevailed... Now that it has already been filed, let's wish all of us good luck and God's mercies.

Thus, in terminating TPS for those countries, DHS adopted a new standard that departed from long-standing practice without any reasoned explanation, in violation of the APA. Id. 11. The Ramos court also found that the plaintiffs had raised serious questions on the merits of their Fifth Amendment claim, which alleged that DHS’s TPS termination decisions and departures from prior practice were motivated and influenced by racial animus against non-white, non-European immigrants. Id.

I never understood why Nepal got TPS in the first place . By the time Nepal got TPS earthquake and after shocks were mostly gone. I never understood how life of illegal neplease or students who were staying in US was in imminent danger, if they would have return to Nepal . Weather we agree or not, almost 100 percent of Neplease who have ability to make all the way to US have some resources back home to feed them self or their family. This freaking theory that we have to support everything that fellow Nepali wants to do is ridiculous. I don’t know how many TPS holder neplease is there, but I am sure 95 percent are student, who came to US in student visa and saying they have ability to tuition. They got TPS for few years good for fellow folks but now eyeing for permanent solution through it just too much.
There are thousands of Indians waiting in line for decade working in H1b to get green card , how fair it is to another fellow human to wait for decade without screwing status or violating any law and wait decade but neplease / Honduras guy get GC just because they earthquake back home. May be Indians will start praying for massive earthquake there.

I may be a minority voice here but what part of Temporary in TPS doesn’t anyone understand. It was meant to be a Temporary reprive for people affected from Natural disasters or conflicts- No where it’s said that it needs to be a permanent. I am not a supporter of this president or the administration but I think it’s past time to stop people using the system unfairly. Just my 2.5 cents

The negative response from fellow Nepalese here blows my mind. When you start argument about being fair or not, you should know that nothing is fair or right, those with right ability at right time just make it righteous. The very fact that you have food in your table but millions of children in the world stay hungry is very unfair, those children work equally hard or even more than you, but they were just born under unfortunate circumstances. Should we make it fair by throwing you and your kids in the middle of desert? Or you think you were smarter than others and you deserved better life than them? Well ,guess what, if you look around there are plenty of people who can make you look dumb. Is it fair that some guy from village just wins DV and gets citizenship while there are people struggling here with perfect history? You should not point fingers at someone just because you were lucky , because when you do so, there are luckier ones, who will make you feel similar if not worse. Everyone has right for better life , just like you. Don’t hate, Participate.

Nothing is fair. You do what can do to get to where you want. If your life is fine, enjoy it. Its for people who wants something and cannot get it where they come from. They didn't wanted a corrupt government and remain always poor and fulfill their dream. They are escaping while they can talking advantage whatever situations bring. Don't forget this how it all started when European migrated here. There is room for everyone here. Not everyone has everything to get them where they want to be. Life is never fair to begin with.

@meraj wow!! By the time TPS for Nepal got approved the earthquake and aftershock was gone! Are you fucking kidding me??? Have you seen the damages it left, the lives lost? You may be ignorant but the parents and relatives of people here in USA were definitely affected by the earthquake. TPS has helped many to get a job, send money to family back home! H1b is a different visa category and DV lottery is different! Don't compare TPS to them

Of course I have seen the impact. And of course I know H1b and Dv are different. But folks tend to miss point that TPS is designed and granted when there is imminent danger to the life of people if they return. Mainly because of war , environmental disaster etc. And keep in mind that it’s for people who are already in US and be forced to go back. Like expired visa etc. This is not source of aid, not permanent solution. For the sake on temporary gain, if folks start using this permanent solution, they will have to think ten time before granting TPS to any other country in case of real disaster. We are literally killing this great humanterian tool. But I doubt any one on these forum cares about it.

meraj , I felt compelled to address your concern about killing humanitarian tool. Your judgement about Nepal being completely restored after the earthquake is flawed in many levels. When you make judgements like that did you consider the severity of situation? Did you loose your house? Did you loose your parents or siblings? Can you try to relate to those who did? You keep making your bold claims about humanitarian crisis but if you can’t be humane towards those who suffered, all your claims doesn’t really matter. And most of those here are only asking for temporary solution, as nothing is permanet anyways. There are those who have been receiving such aids years before Nepal and are still receiving it and rightfully so. Those who suffered in earthquake in Nepal deserve second chance at life as everyone else.

They sued the government calling it a racist? Accusing government of being anti-immigration and being a racist are different things. The court now will either dismiss the case or order govt to review it's decision. Court cannot grant or extend TPS it is something govt has to do. Am I correct ?
