I get TPS and EAD approved now what are my options atleast for 18 months. I have no longer my F1 status it get terminated few days ago. Please i need suggestions regarding job search atleast till my ead vaild . What other immigration options left for me in future ? Please suggest

Congras first of all....since u have now an EAD and legal status for at least Dec 2016, you can now look for any jobs. Look for companies that will agree to sponsor for GC later on.

What does F1 terminated few days ago means? Did you terminate, or school terminate or USCIS terminate? and how!!

I did my biometrics on aug 3. Checked today it said both TPS and EAD approved physical mail will arrive on address.
@maryoamerica le i was on 60 day grace period and i was not able to transfer due to my financial reason . So school terminated my sevis.

No my sevis terminated this week. My DSO send me mail yesterday. Since i didnt transfer my sevies after 60 day

If i were you i would talk to a lawyer and explore the avenues to go about acquiring your goal.

I maintained my F1 all those years and i was supposed to transfer to graduate school but things didnt work as expected due to financial condition. The only hope is work for given time and pray for extension atleast one more time.

Hi Chulbul,

Congrats, on the first one to get TPS at least we know for. It happened at right moment for you, now you can say, due to TPS, I took break on college. I suggest you to work on IT consulting companies, as you are not bound like in OPT. You have more chances of getting job in any discipline. Try to get GC filed from these companies before it expires. Our hope is at least get extended couple times.

Guys I have a similar kind of situation. Not exactly though.
I'm still in F1 but my TPS got approved and I will be travelling for around 45 days(Advance Parole). I will not be able to register for Fall and my school is not letting me take a semester break.

I have been working in OPT / CPT for the past 3 years (H1b not picked twice since life is a beach) and my company will apply for H1b next year again. I hear mixed suggestions about being out of status and applying for H1b. How does that work ? Can I be out of status and still get H1b approved if I get picket.

You are good for 18 months. After 18 months, If TPS doesn't get renewed then you won't have any options to get back to your status which means you can' t get back your status at all.. If you can then try to get back to school to keep maintaining your status.

I THINK(very unsure) your sevis can be temporarily terminated(Unsure of the legal term).
Its similar to getting a semester break and travelling back home. Tell your school hey I'm travelling back home. Get your TPS advance parole. Travel back and apply for school with new I20.

Just a thought though.

TPS doesnt guarrantee any status so get an I20 and go to school. It does give you right to travel and work without any restriction but you cannot go back to F1 after TPS ends if you do not maintain it the whole time long. Also, even if you find a company willing to sponsor greencard, you wont be able to switch to GC from TPS, and that is why you need the valid F1 status. That does mean you need to maintain a fulltime student status as well. It's a bit complicated-make the right decision. Good luck!

Please elaborate.
H1b can be approved even when out of status I believe. You might have to go back and get a stamping but i sure think its possible. Might be wrong how does H1b gets approved for people living out of states.

Yes you will need to go back for visa stamping as far as H1 is concerned, but lets say he doesnt make it to H1 next year and TPS ends dec2016. He is going to be out of status.
Another scenario, Lets say he finds a company who is willing to start his GC processing. However, You cant start it with TPS, but if he continues to maintain F1, he will get to start the applIcation.

Yes h1b be can be approved for people who are out of status. But they have to go back for visa stamping. Its when it gets interesting. Since they have been out of status they will be banned for entering USA depending on the time they have spent as an undocumented alien. Meaning if someone overstayed for 6 months they will ban for 3 years and if its more than a year it is 10 years. There is a waiver for that but it is almost impossible to get such waivers.

And yes you have to be in a some status (f1 / h1 / any other status) to start GC processing. if you don't have any status you are out of lock.

TPS doesn't provide a way to adjust to any other status.

Yes. While TPS approval is not a grant of amnesty (or forgiveness) for prior immigration offenses, you can still apply for and receive the benefits of TPS (including a work permit) if you entered or remained in the U.S. illegally.
Yet another compelling reason to apply for TPS is that once you are approved, your period of unlawful presence in the U.S. will be “tolled” or stopped. That means that the time spent in the United States while a TPS beneficiary will be considered lawful for the purposes of adjusting status and avoiding inadmissibility problems. (For further information, see “Consequences of Unlawful Presence in the U.S. -- Three- and Ten-Year Time Bars.”)

Even if your sevis is terminated you still have 6 months before you can apply for reinstatement. You can apply for reinstatement if you want keeping TPS intact but the problem is you have to go to school which sucks.
