I am working is a american company through indian consultancy.My Opt expired on September but I had my advisor extend my opt (Threre is a new gap rule that covers the opt GAP so I did not have to go to school to cover that gap) but my advisor extended it till September end assuming that BY October 1 I will have decision from USCIS.My h1b is still pending. Now my questions are:
1. what happens if I do not get decision by oct 1?Can I still work in my current job till USCIS give decision or do I need to leave company and country by the end of September?
2. Do I get some time to straight out my status if my h1 get denied? I can not even go to school till january because fall session is already closed.so what happnes to my status for that 3 month?

think ppl do go to GMAT/GRE course to keep their status like in kaplan ......
there are business schools which opens 5 times ie 5 quater system business schools too....
think you got my picture....

. Here are your options. If you have already applied for H1, and are waiting for the decision, then you can stay here on the basis of that application. However, I don't know if you can or cannot work. Another option is to apply for the school session beginning January. The US law allows you to stay for 6 months in the US if you have your I-20 in hand. For example: let's say you apply to a school and get an I-20 next month, which is October. Then, according to the law, you have the right to stay in the US until your school starts. The legal right to stay here if you manage to get an I-20 is 6 months. By that time, your college would have started and you can start attending the college. No need to go out of the country. I suggest you to ask other people with more knowledge on immigration laws. For example: call and ask you previous international advisor from your school.

hey papi sansar,
chill out dont take any tension. i am not sure, so u might wanna call any immigration lawyer and ask. what i have heard is that, if u have already filed a case then u will not loose ur status until ur pending case is over. then after that if its decline u will have 60 days grace period. but like i said u might wanna discuss with a lawyer.

If you have a receipt number for H1-B. You might get it before October 1st. I had mine around last week of September last time.
But if you don't have a receipt number and just believing the Indian Consultancy. Then try to look for other options soon.

If you have receipt nos and then you can call to USCIS and find out what going on. They will response immediately by giving a call in 1-800 numbers.
There is doubt in your thread. If you do not have receipt nos. then then consultancy is taking money till date of September 30 (through your OPT) and may say you already get denied letter.
There are two options, if you are receipt no. call or check online through USCIS websites. However, once the H1 is effective then you will. However, regarding CAP- you can't fall under CAP rules as I know, once you have received allotment letter, then you have suppose and your employer or lawyers must be sent the letter to USCIS within 30days from date of receipt the case nos and we will be able to get such previlages.
So, make sure that and call as soon as possible to USCIS or check through online. Or consult with immigration lawyer ASAP. Even lawyer will take 10/15 days to make filing and documentations.
