I am a international student currently in texas. I went to Northlake college and then its been almost a year i went out of status. In the begening i didn't realise the consequence would be that bad. so i wasent worriying. but later when i realised and tried to reinstate, the college said it could not help because it was already more that 5 months. they said if i want to do something i have to do it by myself. They further told me it would really be no help in me doing it myself because the USCIS could reject me for my bad grades. The other option they told me was to get an I20 frm here and then travel back to Nepal and then come back again. And this is almost impossible as we all know. I am in a situation of dilemma and don't know what to do. I do not want to leave my studies but don't have proper guidance so please if you could help me. YOu'd save a life.

hey chari_badalpari, i know its quite sad and you must be tensed too...I feel sorry for you. I am not sure but you can try one way. One of my friend who was in F-1 status has his visa expired and he went to Canada . Some places in Canada (not toronto ) stamp him f-1 visa and came back to US. You can think about getting an I-20 from the college and going to canada for Visa. Just Think about it .. things may be different for you as you are already out of status.

If its been over 5 months, then its screwed up, unlesss you have exceptional circumstances to show that you werent able to reinstate with 5 months.

Here is my suggestion! Go to Canada or some other country and then apply here again.
You can even go back to Nepal with a i-20. If your visa hasnt expired you can come back without an interview.
Or,
Make a doctors statement saying you were seriouslly ill and has to leave the school.
I suppose you can make that.
If you have courage to be out of status, you can easily do that.

What nayasadak said was right. Chari, since you are in TX, the best thing for u to do is -find an American citizen and get married ASAP. You can have your GC within a year. Everyone does it in TX, you should take advantage of it too. Sooner or later u will need to GC anyway. But again, it's your call. G'luck to you.

Chari here's what i'd do...

- go to college labs and find some geeky looking guy who hangs in front of the computer 24/7

- make friends with him

- increase your friendship with him without any physical connection...

- after few weeks tell him that you have to go to Nepal because of status problem.. he'll try to help you out

- alas the only last resort is to get married and being a friend he might help you out

- you'll be lucky if he agrees to marry you without any physical expectations

- if not be ready to give him a piece of the action

- a year goes by and you get the green card.. love might have flourished among the two, then you can start planning for a baby

- if not, you can still remain friends with him and move on with your life

First of all, I am so sorry that your College could not help you in this matter. Well you still have time to reinstate your F-1. I was a student back in 1997. I Icame to NYC in April 1997 from Oregon. I was a student at Coosbay Community College. I applied to Cuny in NYC when I came. I waited three months prior to Cuny processes the application. Cuny never sent me an approval. I was out of status at that time. I joined Berkeley College in NYC in September of 1997. I met international advisor and applied for reinstatement. I got an approval after four months. But I studied hard and was a full time student. You need to write an essay about reason out of status and reason to be F-1 student. I think that you can also check with Immigration office to get the re-instatement form and write long story to Immigration officer. They will help and listen your voice as they did to me. You will accomplish your goal as I did. I finished my Bachelor in Accounting from Berkeley College in 2001. Therefore, hurry up and you are never late to do good things in life i.e Education. If they don't help you, please call Berkeley College at 212-986-4343 and ask for International Division.

Your case is way too easier, because that happened BEFORE September 11, 2001. Things have changed drastcially since then. I was out of status for few yrs., seriously, for few yrs. and was able to re-instate. But as I said, that was before 9-11. So, my suggestion it get married to an AMERICAN asap. Time flies and u will have GC at no time. You can even go to school after you get your EAD. It's good to be safe than sorry.

explorer is right. go n look for some mexican-american girls if u r a boy or any citizen. i heard that u can still do some kinda papermarriage for 2-3 hundred per month. all u have to do is ask for some ppl who have already done this. i know there are lot of ppl out in texas who got their GC that way.

Chari, first of all do not listen to what people say.. of course, marriage to an US citizen is an option. But you can't just do it for a piece of paper.. it's no different than prostitution if you just marry for a paper. .. if you do fall in love and then get married than that is an option.. kagaji marriage for $$, good luck... but be optimistic.. looks like Bush is making illegals - legal.. no one has brought up that issue, althought it's the heated debate in the senate right now... so be optimistic, don't give up and be healthy, think clean and positive... you'll be happy no matter where...
