Has anyone been through a situation of traveling Nepal after filing I-140 or with the approved 1-140 and prior to filing I-485 and got successful H1-B visa stamp? Thank you very much in advance.

.

I got my stamp in July, I am not upto I140 stage yet, but I did mention my PR process in the visa forms. I had no problem to get visa stamp. I really don't think you will have any problem. Remember H-1B is dual intent and you are not required to prove ties to home country.

however i had some headache with getting stamp from Shram Karyalaya. Make sure you go there in advance and check the requirements and find the "Helper" outside of the office. The requirements are posted on the wall outside Shram Karyalaya.

The "Helper" can comeup with pretty much any required documents..the only things is he will charge some extra fee.

best of luck...

Mr Manas, I have some question for you..
what is the best stage in green card process to get married? I heard that if you marry after I-140 or I-485 you cannot add spouse anymore?
and can spouse apply for EAD while filing I-140 and applicant continue H-1?
Please give me some suggestion..thank you.

Thanks Max101 for your reply. So for the question in the DS156 form "Has anyone ever filed an immigrant visa petition on your behalf" , you answered "YES" and gave the name of your employer right? Also how long you had to wait to get the interview date ?

Regarding your question of marrying after I-140 or I-485 , to the best of my knowledge you have to process your spouse's I-485 also along with yours otherwise once you get your GC then you have wait till you become a citizen in order to sponsor your spouse unless she comes on different non immigrant visa like F1 or H1. I-140 is just an immigrant visa petition filed on your behalf by your employerand I am assuming your GC is employment based. Hopefully other persons in this forum will throw their idea in this subject. To be confirm you can ask your corporate attorney. There are very good information regarding this at www.murthy.com site.
