kasto complex banako kura....i just talked with lawer today here is my example I am working 40 hrs on my OPT which will expire in December, my company applied for H1 both times during my 27 months of OPT+STEM extension and did not get picked on the lottery. My company has already started the GC process and i am waiting for the PERM to approve. But my OPT will expire in December and since i wont be getting GC by december i will be applying for TPS instead to keep my status is legal while my GC processing is running in parallel (I-140/485). This is totally possible.....whoever saying GC based on employment (while in TPS) is not possible need to do some more research.

@Satrianic:As you have done some research on this..can you please advise me on my situation? I finished my undergrad..applied h1 twice..didnt go through lottery each time..opt expired..applied one of those college who provides CPT and currently working under it..any suggestion would be appreciated.

Okay apply for TPS/EAD once approved for Nepal (likely to be in next week or two). Once TPS is approved you can stop going to CPT college but only can start working once EAD is approved ~90 days of application, so you may wanna keep going to CPT college till EAD is approved. Once EAD is approved ask your boss to file form GC (we all know how H1B 2017 gonna turn out again). GC is a long process, just in my case they started in late February and i am still on PERM phase so 18 month of TPS would be barely suffice if you start working on it. Another good news is any nation granted TPS has never been revoked it TPS after month. Atleast they get renewal for 4-5 years. Good luck

i was dead bored @ work..so i visited USCIS site for TPS and the highlighted statement triggered my freaky sense of humor 'if it is feasible to be green via TPS while you are on F1' sounds like it maybe.. GOOD LUCK guys. Just don't mess up your status..
According to the USCIS
"TPS is a temporary benefit that does not lead to lawful permanent resident status or give any other immigration status. However, registration for TPS does not prevent you from:
1.Applying for nonimmigrant status
2,Filing for adjustment of status based on an immigrant petition

once you inform school officer they will mention on i-20 that student has applied EAD based on TPS but that notice should be published at federal register. Even for haiti it was published that till the time TPS is effective for them they can have reduced course load all the semester with consultation with school international advisor. As long as you maintain F1 status based on federal register and apply TPS everybody should be fine. The only thing is have to change school frequently based on job place.

Lets put this way, in few years, i have sent back home the amount 100 times the value than what i would have earned in Nepal in few decades and that money is not being deposited in a bank, they are for expenses and have been spent, circulated through Nepalese market. So i can proudly say by living in US, my personal contribution for increasing Nepals economy is 100 times more compared to if i was living in Nepal. Remember again, remittance is the major source of income for Nepal.

satrianic bro has posted a very helpful information. i think i am in your shoes. I also have masters degree and did not get picked in h1 lottery(stem degree). I have OPT till first week of December 2015. Do we have to attend college if TPS is granted? My consultancy is willing to sponsor gc but they are in recruitment phase. Hate thinking of joining CPT colleges. It would be better to get EAD through TPS ,but well let it be official first .Please advise.

@saptarangi....TPS is likely to be granted to be today or by end of this week.. Even if we apply TPS next week we will get out biometrics done in July and EAD by end of September and can work on TPS right after that, so no need to join CPT college. Even if one is not working and just maintaining their status through CPT/Community colleges they can stop attending one as soon as USCIS announces TPS.

@chulbul...TPS will take of that....one can't simply be granted TPS and be out of status same time. Yes, if your TPS application is denied then you might be out of status but not once you are approved for TPS. TPS is a lengthily process and takes around 3 month for EAD so try to apply as soon as it is announced (likely within 2-3 days).
